1. Agreement to Terms

By accessing or using the Fellow Scale website, services, or engaging us for marketing services, you agree to be bound by these Terms of Service. If you do not agree, you should not use our services.

2. Services

Fellow Scale provides performance marketing, paid media management, campaign strategy, analytics, creative direction, and related digital marketing services.

Scope, deliverables, and timelines are defined in individual agreements, proposals, or onboarding documentation.

3. Client Responsibilities

Clients agree to:

• Provide accurate business and account information

• Grant necessary access to ad platforms, analytics, and storefront systems

• Approve campaigns, creatives, and strategy in a timely manner

• Ensure compliance with advertising platform policies and applicable laws

Fellow Scale is not responsible for delays caused by lack of access, approvals, or inaccurate information.

4. Fees & Payments

Fees are defined in signed proposals or agreements.

Unless otherwise stated:

• Payments are due in advance or per agreed billing cycle

• Late payments may result in paused services

• Ad spend is billed separately and paid directly to platforms unless managed otherwise

5. Performance Disclaimer

Fellow Scale operates as a performance-focused agency, but:

• We do not guarantee specific revenue, ROAS, or conversion outcomes

• Results depend on product-market fit, pricing, offer quality, landing pages, and market conditions

6. Intellectual Property

Upon payment:

• Clients retain ownership of their brand assets and ad accounts

• Fellow Scale retains ownership of internal frameworks, systems, processes, and methodologies

Creative assets may be reused for portfolio or marketing purposes unless restricted in writing.

7. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive business information shared during the engagement.

8. Termination

Either party may terminate the agreement with written notice as defined in the service contract.

Upon termination:

• Access to accounts remains with the client

• Outstanding invoices must be settled

• Work completed up to termination remains billable

9. Limitation of Liability

Fellow Scale is not liable for:

• Platform policy changes

• Ad account suspensions

• Market fluctuations

• Indirect or consequential losses

Total liability is limited to the amount paid for services within the previous billing cycle.

10. Governing Law

We may update these Terms periodically. Continued use of services implies acceptance of updated terms.
